The rules and conditions that govern your use of the SURFLESSONS4YOU platform.

1.1. These Terms and Conditions (T&Cs) govern the use of the booking platform SURFLESSONS4YOU (hereinafter "the Platform" or "We") by customers (hereinafter "Surfer" or "Customer") and the contractual relationship between the Platform, the independent Surf Schools/Instructors (hereinafter "Provider" or "Service Provider"), and the Surfers.
By using the Platform — including browsing, posting,booking, or paying — you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1.2. These Terms apply to all users, regardless of country of residence. By using our services you declare that you are legally capable and, if required, of full age.
1.3. These Terms together with our Privacy Policy and Cookie Policy form the entire agreement between you and SURFLESSONS4YOU regarding use of the Platform.
1.4 The Platform Operator
The Platform is operated by SURFLESSONS4YOU with its principal place of business at [Your Full Address].
2.1. SURFLESSONS4YOU acts solely as a commercial agent / broker. When you book a surf course via our Platform, the contract for that course (“Service Agreement”) is concluded directly and exclusively between you (the guest) and the surf school (supplier).
2.2. SURFLESSONS4YOU does not organize or provide the surf courses itself, does not act as the operator or supplier of the services, and is not the contractual partner for the provision of the surf course.
2.3.The contract for the performance of the booked Activity is concluded directly and exclusively between the Surfer and the respective Provider. SURFLESSONS4YOU does not become a party to the service contract (e.g., the surf lesson contract) and is therefore not responsible for the proper and faultless delivery of the activity.
2.4. SURFLESSONS4YOU receives a commission from the provider for brokering the booking. This commission is already included in the price displayed at checkout (“Booking Price”).
All descriptions, images, and information regarding the activities are provided by the providers. SURFLESSONS4YOU has no direct control over the accuracy, completeness, or timeliness of these contents and is not obligated to verify them.
3.1. To book a surf course, you select your desired course, fill in required personal and payment information, and confirm the booking. Payment is processed via the payment provider (e.g. Credit card or PayPal). Bookings made via the Platform are legally binding. By submitting a booking, the Surfer makes a binding offer to the Provider to conclude a contract for the selected activity
3.2. Once payment is successful, you receive a booking confirmation; this acts as confirmation of the concluded service sgreement between you and the surf school. The contract between the Surfer and the Provider is concluded when the Provider accepts the Surfer's booking via the Platform and/or SURFLESSONS4YOU sends the booking confirmation on behalf of the Provider via email to the Surfer.
3.3. SURFLESSONS4YOU serves as intermediary for payment only; once payment is forwarded to the surf school, your obligation is fulfilled.
3.4. The prices listed on the Platform are final prices. The price includes the intermediation commission retained by SURFLESSONS4YOU.
3.5. SURFLESSONS4YOU reserves the right to refuse or cancel bookings in case of suspected fraud, abuse, or violation of these Terms.
4.1. The Platform is intended for personal, non-commercial use only. Commercial resale, re-listing or profiting from bookings made on behalf of third parties is prohibited.
4.2. You may create at most one user account. You are responsible for maintaining confidentiality of your account credentials and all actions under your account. You must notify us immediately if you suspect unauthorized access.
4.3. Any use of automated tools such as bots, scrapers, or data-harvesters to access or extract data from the Platform without prior written consent is forbidden.
5.1. The prices shown on the Platform (the “Posted Price”) or at checkout (the “Booking Price”) include the commission that SURFLESSONS4YOU earns. This commission is paid by the Provider.
5.2. SURFLESSONS4YOU is authorized by the Provider to collect the payment in the name and on behalf of the Provider from the Surfer. Payment made to SURFLESSONS4YOU fulfills the Surfer's payment obligation to the Provider.
5.3. Applicable local taxes (e.g. VAT, tourist tax) may apply depending on the surf school’s location. If additional local taxes apply, they will be indicated in the course description.
5.4. SURFLESSONS4YOU is not responsible for such local taxes; the surf school (supplier) is responsible for complying with local tax regulations.
6.1. Cancellation or refund conditions depend on the policies of the Provider. Those conditions will be shown in the course description or during checkout. SURFLESSONS4YOU acts only as intermediary and is not responsible for supplier’s cancellation policy.
6.2. If the Provider cancels a course (e.g. due to adverse weather or other reasons), refunds or rebooking options are managed by the Provider. SURFLESSONS4YOU may assist in communication but holds no liability for supplier’s decisions.
6.3. If the Surfer fails to appear at the agreed-upon time and location, they forfeit any right to a refund of the paid price.
7.1. SURFLESSONS4YOU facilitates bookings. We do not guarantee the provision, quality, safety or availability of the surf courses provided by thirdp-party providers. All liability for the actual service lies with the surf school (Provider).
7.2. SURFLESSONS4YOU is not liable for any damage, injury, loss or other negative outcome resulting from participation in a booked activity, unless such liability is mandatory under applicable law (e.g. gross negligence, willful misconduct).
7.3. SURFLESSONS4YOU acts solely as an intermediary platform. The Provider (the surf school) guarantees that they hold all necessary administrative licenses and a valid Public Liability Insurance (or General Liability Insurance) sufficient to cover surf instruction and any potential damages or injuries arising therefrom.
The user acknowledges that surfing is an inherent-risk activity. SURFLESSONS4YOU shall not be held liable for any personal injury, accidents, property damage, or death occurring during the execution of the booked activity. Any claims regarding the safety, quality, or performance of the lessons must be directed exclusively to the respective Service Provider.
7.4. The Surfer acknowledges that surfing and related water sports inherently involve risks (e.g., injuries from waves, board, marine life). Participation is undertaken at the Surfer's own risk and responsibility.
7.5. The booking price does not include insurance coverage. The Surfer is strongly advised to obtain adequate travel, accident, and liability insurance.
7.6 Surfer Obligations
7.6. We are not liable for indirect or consequential damages, including loss of profit, loss of enjoyment, or expected savings, arising from booking or using the Platform.
7.7. We have no obligation to maintain the Platform permanently; we may suspend or discontinue parts or the whole of the Platform at any time without prior notice. Booked Service Agreements already concluded remain unaffected.
8.1. You guarantee that all information you provide during booking is correct and complete (e.g. personal data, payment data, participant numbers).
8.2. You shall comply with the supplier’s rules (e.g. meeting times, safety guidelines, behaviour).
8.3. You are responsible for obtaining any required travel documents, visas, insurance and complying with all legal and health requirements for the course.
9.1. All content on the Platform (texts, images, logos) is protected by intellectual property law. You may not copy, reproduce, modify or distribute any content without prior written permission.
9.2. If you, as a user, upload any content (e.g. reviews, photos), you grant SURFLESSONS4YOU a non‑exclusive, worldwide, royalty-free license to use, reproduce, adapt and display such content for marketing and platform purposes.
10.1. SURFLESSONS4YOU reserves the right to modify these Terms at any time. We will notify users of significant changes by email or via the Platform. Continued use after notification constitutes acceptance.
10.2. We may suspend or terminate your access to the Platform at any time (e.g. due to breach of Terms) with immediate effect. Existing Service Agreements concluded prior to termination remain in force.
These Terms are governed by the law of Germany. Any disputes arising from or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in SURFLESSONS4YOU, Katja Schiefer, Grabko 42, 03172 Schenkendöbern.
The relationship between the Surfer and the Provider may be governed by different laws.
